The municipality sets certain standards that dictate aspects such as setbacks from boundaries, maximum percentage of construction allowed based on land size, and the designated use of the land, known as "Uso de Suelo" in Spanish. It's crucial to conduct thorough due diligence before closing the sale on a property to ensure that you're aware of what can be built and any restrictions that may apply.

Let's explore the various types of plots of land or building lots commonly available:

Residential Building Lots

These come in a few different varieties (listed below). Often, individuals who owned large parcels of land may have divided off a portion to create residential lots. These lots can be located along public roads or sometimes on easements. In order to build a home, these lots must be a minimum of 350 square meters.

Horizontal Condominium Lots

These lots can vary in size, but most are larger than 350 square meters. When purchasing in a horizontal condominium, buyers are obligated to follow the registered covenants and restrictions. These regulations may include specifications for home style, roof materials, monthly maintenance fees, and more. Horizontal condominium lots are always part of a gated community, and the roads within are private. Subdivision of these lots is not possible without unanimous agreement from the condominium association.

Agricultural Lot

By law, agricultural lots must be a minimum of 5000 square meters, or 1.23 acres. These developments are set up under an "agricultural" designation. The roads within these developments are typically easements, which means they pass through another person's property, and vice versa. This information is detailed in the title deed, property registration, and the registered lot survey. Agricultural development land can be subdivided, but each resulting property must still be over 5000 square meters. Most agricultural developments have a homeowners association to manage common areas and expenses. The main home on an agricultural lot can be a maximum of 300 square meters or 3229 square feet.

Urbanization lot

These lots are usually created by segregating a portion of a larger property. The roads within urbanization lots are public, meaning anyone can drive on them. The size of these lots can vary.

Farm land or “Fincas”

When exploring real estate options in Costa Rica, you'll find an abundance of farm lands for sale or "fincas" as they are locally known. Driving around, you'll notice signs on trees and fence posts declaring "Se Vende", which means "For Sale", giving the impression that the entire country is up for grabs. These large tracts of land, typically over one hectare or 2.5 acres, offer ample space for various construction projects. However, it's important not to overbuild and instead prioritize the space you truly need.

As previously mentioned, the local municipality plays a crucial role in determining the land's use, known as "Uso de Suelo." When you find a piece of land you wish to purchase and build on, one of the most important considerations is ensuring a legal source of potable water. This can be supplied by the Instituto Costarricense de Acueductos y Alcantarillados (AyA), a legally registered private well, or in outlying areas, through an ASAD (Las Asociaciones Administradoras de los Sistemas de Acueductos y Alcantarillados), a locally registered association that delivers water via piping.

It is also crucial to ensure that the property has a "Carta de luz", or an electricity availability letter. This document verifies that there is an existing electrical connection to the property, allowing you to obtain an electricity meter. Without this you may face challenges in connecting your property to the power grid, which can significantly impact your ability to develop or live on the land.

Another step when purchasing a property in Costa Rica is to hire a certified topographer to mark the property lines accurately. This ensures that you know the exact dimensions of the property and can identify any encroachments or boundary disputes. Having a clear understanding of the property boundaries is crucial to ensuring that the property is free and clear of any liens or encumbrances. Additionally, a topographic survey can be beneficial for future construction projects, as it provides detailed information about the terrain and topography of the land. This information can help you plan and design your development more effectively, ensuring that it complies with local regulations and avoids any potential issues with neighboring properties.

During the due diligence period, it's essential to ask your attorney to verify all these details: water and electricity availability, survey report, and to conduct a title search. This process confirms that the property is appropriately titled, the seller is the rightful owner, and the property is free of any liens, encumbrances, outstanding debts, or taxes. Due Diligence is Key

 

A title or deed is called an "escritura" in Costa Rica. The first thing you are going to want to find out about a property is if the title is properly registered and free of liens, encumbrances and annotations. This is extremely important because it is common in Costa Rica for properties to have been in a family for years. Often these properties were never properly registered or have had the taxes paid. To do a title search, your lawyer will take the Folio Real Number of the property and insert in the national registry System to ensure it is clean or if it has issues. They will check their records and provide you with current information about the desired property.

 

The process of transferring the title must be prepared by and executed before an registered licensed notary. In North America, a notary only authenticates signatures, but in Costa Rica, the role is much more expansive. To be a notary in Costa Rica, you first must be an attorney, then go to school for 2 more years and pass more exams to become a "Notario" or notary.

 

Closing Costs

 

Home in Mariners Point community of Costa RicaHow much can you expect to pay in closing costs? The custom in Costa Rica is for the buyer to pay the costs. The closing costs will be about 4-5 percent of the purchase price. The seller typically pays the realtor’s commission. Beachfront Property: A Special Case

 

There is only one type of property that a person who has not been a legal resident of Costa Rica for 5 years cannot buy outright, and that is concession beachfront property. The first 200 meters inland from the medium high tide mark is called the Maritime Zone and can only be leased by a concession from the local municipality. This land is not titled. Concessions can be granted for 5 to 20 years, the latter being the more common.

 

The lease could be transferred through a legal shell corporation in which a Costa Rican citizen is the majority shareholder. Keep in mind the first 50 meters from the medium high tide mark is considered a public space and cannot be built on. There are strict requirements for building on the remaining 150 meters. For example, there are restrictions on building heights in certain areas to protect the environment and preserve the natural beauty of the country. So you will want to do all sorts of due diligence BEFORE deciding to purchase the concession.

Costa Rica Law 9416 Requires Shareholder Registration

Costa Rica law 9416, know as the “Law to Improve the Fight Against Fiscal Fraud” (Ley para Mejorar la Lucha contra el Fraude Fiscal), requires that all shareholders and owners of legal entities ( ie corporations that hold property) register their identity with the government. The Banco Central has been tasked with recording the identity of all natural persons that are final beneficiaries of Costa Rican corporations.

They want to know who holds ownership of, exercises control over, or participates significantly in the activities of the legal entity. The only exceptions are corporations that are already under the control of governmental institutions. Examples of such exceptions are pension funds, public trusts, and financial institutions.

Like thousands of other expats, you want to own a piece of paradise in Costa Rica. Of course, you want your property—home, condo, or farm–to be legally registered. What does Costa Rica law require? Can a non-resident fulfill those requirements and thus legally own property in Costa Rica? Those questions are related to recently enacted law 9416. It was passed by the Costa Rican legislature on December 14, 2016 and went into effect on the 30th of that month.

Why does that matter to someone who owns property in Costa Rica? Because often a legal entity is used to hold ownership of that property. The “sociedad anonima” (SA), or Limitada similar to the LLC in the United States, is the legal instrument that is most commonly used for property ownership because it facilitates the transfer of title. According to Law 9416, the president of the SA is the only officer that is authorized to register. And the president must have a “firma digital” (digital signature) registered with the Banco Central in order to comply with the requirement.

Here’s where it gets tricky for non-residents. Only Costa Ricans and foreigners who have permanent residency status can obtain a digital signature. So what do you do if you’re an expat without legal residency and you want to hold property in Costa Rica through a sociedad anonima? How can you legally register it? There is a work-around, but it involves some expense. You can go to a notary public and assign a special power-of-attorney to a third party who will serve as your representative. The person you authorize can be an attorney but doesn’t have to be. As long as the person is a citizen or legal resident of Costa Rica in good standing with the government, they can represent you for registration purposes.

The fines for not filing the information are expensive. Current penalties for failure to register start at $2,250 and can go up to $75,000. Is the law being enforced? That’s a valid question. If you already own a Costa Rican SA or Limitada or are considering the purchase of a property in that is held by either one, it’s smart to check with an attorney. They can provide up-to-date information on Costa Rica law 9416, it’s enforcement, and how it applies to your individual situation.

Why was the law enacted in the first place? Costa Rica is attempting to comply with the rules established by the global financial system. Registration is mandated in order to insure transparency of ownership and to prevent fraud. This, in turn, helps Costa Rica remain in good standing with the international banking institutions that are in important source of funding for Costa Rica’s government.

So do not hesitate if you happen to be a share holder of a Costa Rica corporation. Contact your legal representative here in Costa Rica and get the ball moving as you do not want to deal with penalties or other issues.

Costa Rica’s Luxury Home Tax

Taxes. Everyone’s least favorite topic but important information for those wanting to move to Costa Rica. So what is the luxury home tax? Below, I will go into detail of what this tax is and who it applies to.

What is the Luxury Home Tax and Who Needs to Pay it?

The Solidarity Tax for the Strengthening of Housing Programs or simply put, the luxury home tax, is an additional tax placed on homeowners who own a house, condominium unit, or apartment with a current value over ¢133,000,000.00 (approximately US$ 214,500).

Every 3 years, homeowners must do a luxury home tax evaluation to determine if their dwelling in Costa Rica is subject to the Luxury Home Tax. The tax rates start with 0.25% and end in 0.55% of the home’s value, determined by the home evaluation performed specifically for the luxury home tax. Payments of this tax must be made by Jan. 15 each year or penalties will be imposed.

The value of your constructed home, along with other improvements such as swimming pools, walls, bodegas, ranchos, sports fields, etc. is what will determine whether or not you need to pay this tax. The threshold at which the tax goes into effect only applies to these types of construction and improvements, but not the land itself. The land value will be added to the construction value only after you surpass this threshold. Then you will have to pay the tax based on the entire amount.

So what's the next step?

If you are a homeowner that is currently paying the tax, you should perform a new evaluation to determine if the dwelling remains subject to the tax for the next 3 years. As well as if there are any changes in regards to how much the tax would be for those following 3 years or if the home is even still subject to the tax.

If you are a homeowner that bought a new house, condo, or apartment during 2019-2021, you should perform the evaluation to determine if the dwelling is subject to the tax for the next three years.

If you are a condominium unit owner with an area of over 120 square meters (1,292 square feet) you should contact the condominium administrator to determine if there is a decision about addressing the valuation as a group and if not, consider performing his/her own evaluation.

In Conclusion

Taxes are not always a pleasant topic, but they truly are a small price to pay to live in paradise! These taxes are also very beneficial to the Costa Rican people because the purpose of this luxury tax is to build homes for people living in poverty.
